Juridical-legal analysis of consumer's right to blood

Abstract
Background and Objectives
One of the most fundamental rights of consumers of blood products should be the right to health, according to which the right should be recognized by the Blood Transfusion Organization and all necessary measures to collect healthy and safe blood to the consumer. The main purpose is to establish relationships between consumers of blood products and explain the various aspects of their right to health as their most fundamental right.
 
Materials and Methods
This descriptive-analytical study is based on library analysis of legal regulations and jurisprudence. Therefore, the present study did not have a definite sampling because of its qualitative nature.
 
Results
This right is supported by jurisprudential rules such as the rule of no-harm, casuality and loss, and there are precise enforcement guarantees in jurisprudence that can serve as a general basis for blood transfusion and blood products, and in Iranian law as well. The right basis is found, and this right is specifically mentioned in the Statute of the Organization and in the Executive By-Law of the Activities of Blood Banks and Blood Consumer Centers.
 
Conclusions 
Ultimately, about the consumer of blood products, the right to health has been acknowledged as the institution of blood monitoring and care. According to the Hemovigilance Division, the Blood Quality Assurance Division fulfills this obligation as well as the legislator responsible for blood bank. There have also been commitments to the need for healthy blood, which affirm the respect for the right of consumer of blood products to the right to health.
