fa تحلیل فقهی ـ حقوقی حق مصرف کننده فرآورده‌های خونی برسلامت Juridical-legal analysis of consumer's right to blood products on health حقوق MSc in Law and Finance پژوهشي Research <div style="text-align: justify;">چکیده سابقه و هدف یکی از اساسی‌ترین حقوق مصرف‌کنندگان محصولات خونی را باید حق بر سلامت دانست که بر مبنای آن، حق مورد نظر، باید از سوی سازمان انتقال خون به رسمیت شناخته شده و تمامی اقدامات لازم برای وصول خون سالم و ایمن به مصرف‌کننده‌های فرآورده‌های خونی صورت گیرد. هدف اساسی، ایجاد انتظام در روابط بین مصرف‌کننده‌های محصولات خونی و تشریح جنبه‌های مختلف حق ایشان بر سلامت به عنوان اساسی‌ترین حق آن‌ها است. مواد و روش‌ها روش تحقیق در پژوهش حاضر، توصیفی- تحلیلی بوده و مبتنی بر تحلیل کتابخانه‌ای مقررات قانونی و بیان فقهاست. لذا اثر حاضر به علت کیفی بودن، نمونه‌گیری مشخصی نداشته است. یافته‌ها حق مزبور مبتنی بر قواعد فقهی نظیر قاعده لاضرر، تسبیب و اتلاف مورد حمایت قرارگرفته و ضمانت‌های اجرایی دقیقی در فقه برای آن متصور هست که می‌توان مبنای عام مزبور را در مورد انتقال خون و فرآورده‌های خونی نیز مجرا دانست و در حقوق ایران نیز مبنای مورد نظر یافت می‌شود. به طور خاص در اساسنامه تشکیل سازمان و نیز در آیین نامه اجرایی فعالیت بانک‌های خون و مراکز مصرف خون به این حق اشاره شده است. نتیجه گیری نتایج تحقیق نشان داد درخصوص مصرف‌کننده محصولات خونی، حق بر سلامت تحت عنوان تشکیل نهاد نظارت و مراقبت بر خون مورد تایید قرارگرفته است که بر اساس آن بخش هموویژلانس و بخش تضمین کیفیت خون، این تعهد را ایفا می‌نمایند. هم چنین قانون‌گذار برای مسئول بانک خون نیز تعهداتی بر لزوم سالم‌سازی خون در نظر گرفته که مؤید احترام به حق مصرف‌کننده فرآورده‌های خونی به حق بر سلامت است.  </div> <div dir="rtl" style="text-align: left;">Abstract Background and Objectives One of the most fundamental rights of consumers of blood products should be the right to health, according to which the right should be recognized by the Blood Transfusion Organization and all necessary measures to collect healthy and safe blood to the consumer. The main purpose is to establish relationships between consumers of blood products and explain the various aspects of their right to health as their most fundamental right.   Materials and Methods This descriptive-analytical study is based on library analysis of legal regulations and jurisprudence. Therefore, the present study did not have a definite sampling because of its qualitative nature.   Results This right is supported by jurisprudential rules such as the rule of no-harm, casuality and loss, and there are precise enforcement guarantees in jurisprudence that can serve as a general basis for blood transfusion and blood products, and in Iranian law as well. The right basis is found, and this right is specifically mentioned in the Statute of the Organization and in the Executive By-Law of the Activities of Blood Banks and Blood Consumer Centers.   Conclusions  Ultimately, about the consumer of blood products, the right to health has been acknowledged as the institution of blood monitoring and care. According to the Hemovigilance Division, the Blood Quality Assurance Division fulfills this obligation as well as the legislator responsible for blood bank.
